Spain's 100% tax on foreign buyers lapses with the election

Published

For anyone weighing property in Spain, one cloud has passed for now. The proposal to charge non-EU buyers who are not resident in the European Union a tax of 100 per cent on the value of the homes they buy, first put forward in early 2025, lapsed when the Spanish parliament was dissolved in October 2026, a quiet turn for luxury real estate in Europe's south.

The bill never reached a debate: by the end of March 2026 it had had no reading, no committee work and no vote. On 5 October the prime minister, Pedro Sánchez, announced the dissolution of the Cortes after parliament rejected the government's housing decrees, and called a general election for 29 November 2026. Pending bills fall with the dissolution, and the measures now before the standing committee do not include the tax.

It could return under a future government, so it is worth watching after the election. The Golden Visa for property, closed on 3 April 2025, has not come back. For buyers on the Costa del Sol, in Marbella and on Mallorca, the rules on purchase are, for now, the ones that applied before.
